Kimberly Drake, the daughter of Dr. and Mrs. Martin Bruce Harbison of Cullman, County, was born in Fort Bragg, North Carolina on May 25, 1967. She attended public schools in Cullman County before attending The University of Alabama. Kimberly received a Bachelor of Arts Degree at UAB in 1991; and later received a Bachelor of Science Degree in Nursing from The University of Alabama in Huntsville. Thereafter, Kimberly obtained her Doctor of Jurisprudence from Birmingham School of Law where she was admitted as a member of Signa Delta Kappa for academic excellence. After passing the state bar exam, she was admitted to practice in the northern and middle Federal Districts of Alabama (Montgomery and Birmingham).

Kimberly was married in May, 1990 to attorney Thomas E. Drake, II of Cullman where the two reside with their three children: Sara Beth, age 14; Teddy, age 13; and Herrin, age 11. The family are members of Sacred Heart Church of Cullman.

Kimberly's father-in-law is the former Speaker of the Alabama House of Representatives, Tom Drake, who with his wife, Chris, continue to practice law in Cullman.

Kimberly Drake will write an opinion on every case submitted to the court.

 Kimberly Drake will put an end to “No Opinion” opinions.

 Kimberly Drake will reinstate oral arguments to the Court of Civil Appeals.  These “question and answer” sessions are in my opinion, fundamental to ones right to be heard.  Much more may be learned than what is simply noted in litigant’s briefs.  I wonder why the judicial building has courtrooms, if no oral argument is to be held.

 Kimberly Drake cannot be bought.

 Kimberly Drake will protect, defend and give due effect to the Bill of Rights.  I believe that the Constitutions of the United States ; and the great state of Alabama , were created as a restraining order first and foremost, to protect the liberty of our citizens and their children from governmental encroachment and aggression upon those fundamental rights.  My reading of the Bill of Rights does not stop at the Second (2nd ) Amendment.

 Kimberly Drake believes in protecting liberty and privacy at all costs; regardless of what may appear popular, in vogue, expedient, or politically correct.
